Trott’s Carpet – Terms and Conditions of Sale and Installation

Welcome to Trott’s Carpet. These Terms and Conditions (“Terms”) apply to all purchases, sales, and installation services provided by Trott’s Carpet. By placing an order, making a payment, or scheduling installation, you agree to the following:
1. Payment Terms
A 50% deposit is required to initiate all orders. The remaining balance is due upon completion of installation unless otherwise stated in writing. Any unpaid balance after 30 days of completion will incur a 1.5% monthly finance charge (18% annual rate) or the maximum allowed by Florida law.
Customers are responsible for all reasonable collection costs, including attorney fees, if collection becomes necessary.
No warranty, repair, or service claim will be honored unless the purchase has been paid in full.
Materials and Products
All flooring materials are warranted solely by the manufacturer in accordance with their published warranty terms.
Trott’s Carpet makes no separate or additional product warranties, including for color variations, texture differences, dye lot changes, or natural material characteristics.
Installation Warranty
Trott’s Carpet provides a one-year installation warranty covering defects in workmanship under normal residential or commercial use.
This warranty does not cover damage caused by:
- Improper maintenance or cleaning products
- Water intrusion, flooding, or humidity
- Structural movement or subfloor conditions
- Misuse, neglect, or accidents
Warranty service is limited to repair or reinstallation of affected areas, at Trott’s Carpet’s sole discretion, and is valid only after full payment has been received.
Scheduling and Access
Installation dates are estimates and may be rescheduled due to product availability, weather, or other factors beyond our control.
Customers must ensure the job site is ready and accessible at the scheduled time. Additional charges may apply for delays caused by site conditions or lack of access.
Returns and Cancellations
All special orders are non-cancellable and non-returnable once materials are ordered.
Stock items may be returned only if unused, in original packaging, and approved by Trott’s Carpet within 10 days, subject to a restocking fee. Installed materials cannot be returned or refunded.
Limitation of Liability
Trott’s Carpet’s total liability is limited to the original purchase price of materials and services provided.
We are not responsible for indirect, incidental, or consequential damages, including but not limited to loss of time, use, or profit.
Governing Law and Venue
These Terms are governed by the laws of the State of Florida, and any disputes shall be resolved exclusively in the courts of Volusia County, Florida.
Acceptance of Terms
Payment of any portion of an invoice, signing of a sales order, or scheduling of installation constitutes acknowledgment and acceptance of these Terms and Conditions.
